1. Scope and contracting party
These Terms & Conditions apply to every paid Premium subscription purchased through elltecanalysis.com. The contracting party is Lukas Köppl — EllTec Analysis, sole proprietorship, Kolpingstraße 24, 84030 Ergolding, Germany, email: info@elltecanalysis.com (see the Legal Notice for full details). This website is directed at consumers.
2. Subject matter
The contract covers a digital Premium subscription that unlocks the paywalled sections of the analysis content published on this website. Access is granted immediately online after the contract is concluded; no physical medium is delivered. The website's freely accessible content is unaffected by this contract.
3. Formation of contract and registration
A registered user account is required. The contract is formed when the customer places a binding order for the chosen subscription option during checkout (Stripe Checkout) and authorizes payment. EllTec Analysis confirms the contract electronically (by granting access and, where applicable, through Stripe's payment confirmation).
4. Prices and payment terms
Two subscription options are available: €49 per month or €390 per year. Prices are stated as final consumer prices. Lukas Köppl (EllTec Analysis) makes use of the small-business exemption under § 19 of the German VAT Act (UStG); the stated prices therefore do not include VAT, and no VAT is shown separately, in accordance with § 19 UStG. Payment is collected in advance for the chosen billing period (monthly or annual) by credit card or another payment method offered through Stripe.
5. Payment processing by Stripe
Payment is processed entirely by the payment provider Stripe, Inc. (San Francisco, USA). EllTec Analysis never receives full card details. See the Privacy Policy for details on Stripe's data processing.
6. Term and cancellation
The subscription runs for the chosen billing period (one month or one year) and automatically renews for the same period unless cancelled before the current period ends. Cancellation is possible at any time, effective at the end of the current billing period, either self-service via the Stripe customer portal (accessible from the "Account" area of this website) or by email to the contact address above. On cancellation, Premium access remains available until the end of the period already paid for; no pro-rata refund is given for the unused portion of a period, to the extent permitted by law.
7. Failed payments
If a due payment fails, Stripe automatically attempts to charge the payment method again several times according to the default settings configured in our Stripe account ("Smart Retries"). If a payment ultimately fails, that is, after several automatic retry attempts by the payment provider Stripe, the subscription is automatically cancelled. Access to Premium content ends at that same point in time. Regardless of that schedule, Premium access is automatically suspended as soon as the subscription's status with Stripe is no longer "active" or "trialing", and automatically restored once an outstanding payment is successfully processed.
8. Immediate performance and expiry of the right of withdrawal
During checkout, the customer is explicitly asked whether performance of the contract (granting Premium access) should begin before the withdrawal period has expired. If the customer gives this consent and confirms they are aware that doing so extinguishes their right of withdrawal, that right expires under § 356(5) BGB as soon as EllTec Analysis has begun performing the contract. 9. Limitation of liability
The content of published analyses is governed primarily by the Disclaimer. EllTec Analysis is liable without limitation for intent and gross negligence, under the German Product Liability Act, and for injury to life, body or health. For slightly negligent breaches of material contractual obligations (cardinal obligations), the fulfilment of which makes proper performance of the contract possible in the first place and on whose observance the user may regularly rely, liability is limited to the foreseeable damage typical for this type of contract at the time of conclusion. Liability for other slightly negligent breaches of duty is excluded. This is without prejudice to the content-related limitations of liability for analyses and educational material described in the Disclaimer section.
10. Changes to these terms
Changes to these Terms will be communicated to the user in text form (e.g. by email) at least six weeks before they take effect. If the user does not object to the amended terms within six weeks of receiving the notice, the changes are deemed accepted. The user will be specifically informed of this consequence in the notice. In the event of an objection, either party has the right to terminate the agreement in the ordinary course at the next possible date.
11. Governing law
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not affect any mandatory consumer-protection provisions of the country in which the customer has their habitual residence.
12. Venue
For merchants, legal entities under public law, or special funds under public law, the exclusive venue for all disputes arising from this contract is the registered seat of EllTec Analysis (Ergolding, Germany). For consumers, the statutory rules on venue apply.
13. Severability
Should any individual provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
